This Privacy Policy describes how Kidiverse ("Kidiverse," "we," "us," or "our") collects, uses, stores, shares, and protects information gathered through our physical Facility, our website at www.ourkidiverse.com, our online booking and check-in systems, and all related Services. By using our Services, you agree to the terms of this Privacy Policy.
Kidiverse is a family-first business serving children and their caregivers. We treat the personal information of every Guest, and especially information relating to children, with the highest standard of care and the full weight of our legal obligations.
This Policy applies to all visitors to our Facility, all users of our website, all individuals who complete a Waiver, make a booking, purchase a membership, enroll in a program, or communicate with us in any form. Where information relates to a Minor, the parent or guardian is treated as the accountable party for the purposes of consent and rights under this Policy.
We collect personal information that you actively provide, including: full name of the Guest, parent, guardian, and/or child; date of birth; email address; phone number; billing address; payment card information (processed by secure third-party processors); digital signature; children's names and dates of birth submitted on waivers; Guest profile data including stored Waiver records, account preferences, and emergency or accommodation information; event linkage data associating a Guest profile and Waiver with a specific Booking or event identifier; class enrollment data including pre-authorization hold records and class minimum status; group size and event preferences; military identification details; organization name and Tax ID for group bookings; government-issued photo identification documents uploaded at the time of booking for reservation types requiring ID verification under Section 23 of the Terms of Service, including driver’s license, state ID, passport, permanent resident card, military ID, tribal ID, or other current government-issued photo ID; Guest dashboard data, including account credentials, transaction history, booking edit history and audit logs, dashboard interaction logs, and support chat records; merchandise order data, including shipping address, order history, return and exchange records, and merchandise preferences; Class Referral Program data, including invite links generated, friends invited, completed referral bookings, and rewards earned; waitlist, interest list, and pre-launch signup data for experimental or proposed Services; and Party Profile Form data submitted by a booking parent or guardian in connection with a Birthday Party, Private Party, or similar scheduled event, including the celebrant child’s interests, favorite color, family nickname, things the child finds exciting or overwhelming, preferred level of attention or participation during the event, desired peak moments, song requests, and similar event-personalization details; guest experience information submitted by the booking parent about other children expected to attend, including approximate ages, first-time visitor status, accommodation requests, and allergy, dietary, medical, or accessibility needs flagged by the booking parent for the safety of the guest group; cake and food specifications including flavor, filling, frosting, dietary preferences, message text, design preferences, theme palette, and inspiration photographs uploaded through the form; a designated day-of contact phone number used by the party host and Facility staff for event-day coordination only; open-ended responses submitted in connection with party personalization (for example, the booking parent’s stated definition of a successful event); and similar event-personalization and operational information submitted through Kidiverse intake forms.
Certain Kidiverse intake forms, including the Party Profile Form, use an auto-save feature that transmits form entries to Kidiverse servers as the booking parent or guardian types, before final submission. Auto-save protects work in progress from being lost. Auto-saved entries are stored under the booking parent or guardian’s Guest profile and are subject to the same uses, retention periods, and security protections set out in this Policy. A booking parent or guardian may discard an unsubmitted draft at any time by closing the form without selecting Save and Submit, in which case Kidiverse will retain only the most recent auto-saved version until it is overwritten, replaced by a submitted version, or purged in the ordinary course of system maintenance.
When you visit our website, we and our service providers automatically collect technical information including: IP address and approximate location; browser type and version; pages visited and time spent; referring URL; device identifiers; and cookie and tracking data. See Section 8 for details on cookies.
Our website uses third-party analytics and advertising tools, which may include Google Analytics, Meta Pixel (used to support Facebook and Instagram advertising), and similar platforms. These tools collect behavioral data about how visitors interact with our website, including pages viewed, session duration, and actions taken. This information is used to analyze website performance, measure advertising effectiveness, and deliver relevant promotional content to users who have previously visited our site.
These third-party tools may set their own cookies or tracking technologies on your device. Their use of your data is governed by their respective privacy policies. You may opt out of Google Analytics tracking at tools.google.com/dlpage/gaoptout. You may opt out of Meta advertising through your Facebook ad preferences at www.facebook.com/settings/ads.
Kidiverse may use retargeting technologies to display advertisements to users who have previously visited our website, through platforms including Facebook, Instagram, and Google. These ads are served based on your prior browsing activity and are facilitated by cookies or pixel tracking. If you do not wish to receive retargeted advertisements, you may adjust your preferences through the relevant platform's ad settings, or through the Network Advertising Initiative opt-out tool at www.networkadvertising.org/choices.
Use of our complimentary Facility Wi-Fi may result in basic connection data including device identifiers being logged. This data is used for network management and security only.
Our Facility is monitored by video-only security cameras throughout, including all play zones, party rooms, lobbies, hallways, the snack bar area, and the front desk. Cameras do not record audio. Cameras are not installed in restrooms, changing areas, or any other location where a Guest has a reasonable expectation of privacy. Footage may be recorded and retained for the time period specified in Section 7. Footage may be used for safety and security, incident investigation, insurance and legal defense, staff training, and operational review. Footage may be reviewed by Kidiverse management, shared with law enforcement in response to a credible threat, lawful request, or investigation, and shared with Kidiverse’s insurers and legal counsel in connection with any claim.
By signing the Kidiverse Waiver, you grant Kidiverse and its engaged third-party photographers, including its affiliated partner Rogue Cinematography LLC, permission to capture and use photographs and video of Guests, including minor children in your care, for Kidiverse social media and marketing use. To opt out of marketing photography for a specific visit, notify Kidiverse staff in writing at the time of arrival. Opt-out notifications apply to that visit only, must be repeated at each visit, and are not retroactive to photographs or video previously captured or published. Security camera recording at the Facility is distinct from marketing photography and cannot be opted out of. Use of all photographs, video, and security footage is further governed by the Kidiverse Waiver and these Terms.
Kidiverse is committed to full compliance with the Children's Online Privacy Protection Act ("COPPA"), 15 U.S.C. 6501 et seq., and the Children's Online Privacy Protection Rule, 16 C.F.R. Part 312. We do not knowingly collect personal information directly from children under the age of 13 without verifiable parental consent, whether the collection occurs through our website, our booking platform, or any other means. All personal data relating to children is collected from the parent or legal guardian through the Waiver process or other intake forms completed by the parent or legal guardian. Any personal information relating to a child under 13 that comes into Kidiverse’s custody is excluded from marketing audiences, advertising pixels, and any other marketing or advertising use, as described elsewhere in this Section 3.
Information about children is used solely to: verify eligibility for entry; maintain accurate occupancy and headcount records required for safety; fulfill booked events; and contact the responsible parent or guardian in an emergency. We do not use children's information for marketing purposes. We do not disclose personal information about a child to any third party under any condition, except where disclosure is required by a court order, subpoena, or equivalent compulsory legal process, or is necessary to respond to a credible threat to the safety or life of the child, another person, or the public. The limited transmission of event-personalization details to event vendors strictly engaged to deliver a booked event under Section 6.1 is treated as an operational use to fulfill the booked Service rather than a disclosure to a third party for the vendor’s independent purposes; vendors are bound by written agreement not to use information received from Kidiverse for any purpose other than fulfilling the booked Service and not to share that information further.
For Birthday Parties, Private Parties, and other scheduled events, Kidiverse may collect additional information about the celebrant child from the booking parent or legal guardian to personalize the event. This may include the child’s interests, favorite color, family nickname, things the child finds exciting or overwhelming, preferred level of attention or participation during the event, and similar event-personalization information. Information of this type is collected from the parent or legal guardian, not from the child directly, and is used solely to deliver a personalized event experience. Event-personalization information is not used for marketing, advertising, profiling, or any purpose unrelated to fulfilling the booked event, is not shared with advertising platforms or used to build customer audiences, and is retained only for as long as reasonably necessary to deliver the event and complete reasonable post-event follow-up.
A booking parent or guardian may also submit personal information about other children expected to attend a scheduled event, including approximate ages, first-time visitor status, accommodation requests, and any allergy, dietary, medical, or accessibility information flagged by the booking parent for the safety of the guest group. By submitting any information about another child or about any other third party through a Kidiverse intake form, the booking parent or guardian represents that they have the authority to share that information with Kidiverse for the limited purposes described in this Policy, and that they have, where appropriate, informed the parent or guardian of the other child that the information is being shared with Kidiverse. Information about other children or other third parties submitted through a Kidiverse intake form is used solely to support the safety, supervision, and personalization of the booked event, is held to the same standard of care that applies to information about the celebrant child, is not used for marketing or advertising of any kind, and is retained only for as long as reasonably necessary to deliver the event and complete reasonable post-event follow-up.
If you believe a child's personal information has been submitted without appropriate parental consent, contact us at info@ourkidiverse.com immediately so we may take appropriate action.
We use collected information to: provide and manage our Services; process payments; maintain Waiver records for safety and liability purposes; communicate about bookings, memberships, classes, parties, field trips, and other Kidiverse programs; conduct marketing, advertising, and outreach activities of every kind, including the activities described in Section 4.1; respond to inquiries and complaints; manage group bookings and field trips; maintain occupancy records; analyze and improve our website; enforce these Terms; comply with legal obligations; and investigate incidents, injuries, or security concerns.
By providing information to Kidiverse in connection with the Waiver, any booking, any membership, any class or program registration, any contact form submission, or any other interaction with our Services, you acknowledge and agree that Kidiverse may use that information, on its own behalf and through its service providers, for marketing, advertising, audience development, and outreach purposes. These purposes include but are not limited to the activities described below.
Kidiverse may use Guest information to: build and manage customer segments based on visit history, booking type, membership status, family composition, geographic area, and other attributes; deliver personalized marketing communications about Kidiverse products, programs, deals, parties, classes, field trips, memberships, and partner offerings; deliver paid advertising through third-party platforms, including Meta (Facebook and Instagram), Google, TikTok, YouTube, and other advertising networks; create custom audiences and lookalike audiences on advertising platforms, including the upload of hashed Guest identifiers (such as hashed emails or phone numbers) to those platforms for matching purposes; conduct retargeting campaigns through cookie-based and pixel-based tracking; measure the effectiveness of marketing campaigns, including conversion tracking, attribution modeling, and reporting; conduct A/B testing and optimization of marketing creative; share aggregated and anonymized insights with third-party partners; and engage in any other marketing, advertising, or outreach activity reasonably related to the operation and growth of Kidiverse.
The data categories that may be used for these purposes include contact information (name, email address, phone number, mailing address); booking and transaction history; membership status; class and event participation; party type and package; preferences and event details; communications and feedback you have provided; website and pixel-based behavioral data; and inferences drawn from the foregoing. Review content submitted through the Kidiverse Review Prompt described in Section 16 of the Terms of Service, including the review text, the star rating, and the Guest’s first name and last initial, is used in Kidiverse marketing channels only where the Guest has affirmatively consented to such use on the Kidiverse Review Prompt at the time of submission, and is governed by the consent and revocation terms in Section 16 of the Terms of Service. Private feedback submitted on the under-four-star path of the Kidiverse Review Prompt is treated as operational data, is used solely for service investigation, response, and operational improvement, and is not used for marketing or audience-building purposes unless the Guest separately consents in writing. Information collected from Minors will not be used for the marketing purposes described in this Section 4.1; see Section 3 for the special protections that apply to children’s information. Government-issued photo identification documents uploaded by Guests under Section 23 of the Terms of Service are collected only on the basis of the affirmative consent the Guest provides on the ID Upload Consent Acknowledgment described in Section 23.6 of the Terms of Service, are excluded from all marketing, advertising, profiling, and audience-building uses, and are subject to the storage, retention, access, and Guest rights provisions of Section 23.4 of the Terms of Service.
Your right to opt out of specific marketing communication channels is preserved at all times. You may unsubscribe from marketing emails, opt out of marketing text messages, and adjust your advertising preferences as described in Sections 5 and 10. Opting out of a communication channel does not, on its own, withdraw your consent to the underlying data uses described in this Section 4.1. To request the withdrawal of consent to data-based marketing uses, contact the Privacy Officer at the contact information in Section 14.
We send two categories of communications, and the opt-out rules differ for each:
These are communications necessary to complete or manage your relationship with Kidiverse. They include booking confirmations, Waiver receipts and reminders, payment receipts, party coordination calls, safety notices, and any communication required by law or contractual obligation. You cannot opt out of transactional communications while actively using Kidiverse Services, because they are necessary to provide those Services.
These are promotional communications about deals, events, memberships, parties, classes, field trips, and Facility news. By providing your email address in connection with a Waiver, a booking, a membership, a program registration, an inquiry, or any other interaction with our Services, you consent to receive marketing email communications from Kidiverse. By providing your information in those contexts, you also consent to the underlying marketing data uses described in Section 4.1, which apply regardless of whether you receive marketing email. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting info@ourkidiverse.com. Unsubscribing from email does not, on its own, withdraw consent to the underlying marketing data uses described in Section 4.1; to withdraw consent to those data uses, contact the Privacy Officer at the contact information in Section 14. Opting out of marketing communications does not affect transactional communications.
Providing a phone number to Kidiverse in connection with a Waiver, booking, membership, or other transaction does not by itself constitute consent to receive text message (SMS) communications. SMS consent is collected through a separate, clearly marked opt-in process at the time of booking, membership signup, or other applicable point of contact. Transactional SMS consent and marketing SMS consent are collected through two independent checkboxes, each unchecked by default. If you have opted into transactional SMS, Kidiverse may send you booking confirmations, appointment reminders, party coordination, and safety notices. If you have separately opted into marketing SMS, Kidiverse may also send you promotional and marketing text messages. Neither type of SMS consent is a condition of entry or of completing any transaction with Kidiverse. You may opt out of any SMS communications at any time by replying STOP to any message from us or by contacting info@ourkidiverse.com. Message and data rates may apply. Kidiverse’s SMS practices comply with the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. 227.
A phone number provided through a Party Profile Form or similar event-specific intake form as the designated day-of contact number is used by Kidiverse and its party host staff for transactional event-day coordination only, such as a host call about arrival, headcount, or logistics on the day of the event. A day-of contact number does not on its own constitute consent to receive transactional or marketing SMS, and Kidiverse will not send SMS to a day-of contact number unless the Guest has separately opted into transactional or marketing SMS through the process described above.
We do not sell your personal information to any third party. We share information only in the following circumstances:
We engage trusted third-party providers including payment processors, booking platform providers (including Cojilio), email service platforms, website hosting providers, Google Analytics, Meta Pixel, and other analytics tools. These providers are authorized to use your information only to perform services on our behalf.
Kidiverse also shares limited information with event vendors engaged to fulfill a specific scheduled event, where the sharing is necessary to deliver the booked service. Kidiverse has engaged Chef Nylah / Nylah Inc. ("Chef Nylah") as its exclusive catering partner for hot food at Birthday Parties and Private Parties under Section 6.12 of the Terms of Service. Chef Nylah does not provide cake, and cake is supplied through a separate cake vendor under the Kidiverse Vendor Program (Section 6.14 of the Terms of Service). Kidiverse has also engaged Rogue Cinematography LLC ("Rogue"), a wholly owned subsidiary of The Projekt LLC, as its exclusive partner for in-house photography and videography services at the Facility under Section 6.13 of the Terms of Service. Where a booking parent or guardian selects either service through the Party Profile Form or at the time of booking, Kidiverse transmits the relevant portions of the Party Profile Form to the applicable partner by email. For Chef Nylah, this includes the catering selections, flavor and dietary preferences, allergy restrictions, guest count, and the booking parent or guardian’s contact information. For Rogue, this includes the celebrant child’s name, age, party theme, designated peak moments to capture, photography and videography preferences, and the booking parent or guardian’s contact information. Kidiverse also shares limited customer contact and event information with other vendors participating in the Kidiverse Vendor Program under Section 6.14 of the Terms of Service when a Guest selects a vendor’s service at checkout, including category-specific event details necessary for the vendor to fulfill the service. Each event vendor is authorized to use information shared by Kidiverse only to fulfill the specific order or service and may not use that information for its own marketing or for any other purpose. Personal information about minor children is shared with event vendors only to the extent necessary to deliver the booked event and is subject to the protections described in Section 3 of this Policy. Information shared with event vendors continues to be governed by this Policy, and Kidiverse will respond to access, correction, and deletion requests covering vendor-held information as described in Section 10.
We may disclose information when required by law, court order, or lawful government request, or when we reasonably believe disclosure is necessary to protect the rights, property, or safety of Kidiverse, our Guests, our staff, or the public. This includes sharing with law enforcement in response to a credible threat or investigation.
Signed Waiver records, including names, dates of birth, digital signatures, and submission timestamps, may be disclosed to Kidiverse's legal counsel, insurers, or courts in connection with any personal injury claim, dispute, or legal proceeding. This disclosure is a permitted and necessary use of Waiver data, and it takes precedence over any deletion request during the mandatory retention period described in Section 7.
If Kidiverse undergoes a merger, acquisition, or asset sale, your information may be transferred as part of that transaction. We will provide notice of any such transfer, and the acquiring entity will be bound by a comparable privacy policy.
If you have consented to photography through the Waiver, images and video may be shared on Kidiverse's social media accounts and used in marketing materials. Withdrawal of consent does not require removal of previously published material from third-party platforms.
We retain personal information as long as necessary to fulfill the purposes for which it was collected or to comply with legal obligations. Specific retention periods:
- Waiver records: Minimum five (5) years from the date of signing, consistent with Florida's statute of limitations for personal injury claims. Guests may not request deletion of Waiver records during this mandatory retention period.
- Booking and transaction records: Minimum seven (7) years for financial and tax compliance.
- Marketing communications: Until you opt out; your preference is then stored to prevent future unsolicited contact.
- Security camera footage: Up to thirty (30) days unless preserved for a specific incident investigation.
- Uploaded government-issued ID images: Retained indefinitely as part of the Guest account record in an encrypted storage system. Guests may request deletion subject to active claims, disputes, or regulatory retention obligations.
- Guest dashboard edit history and audit logs: Minimum seven (7) years to support dispute resolution and legal proceedings.
- Website analytics data: Retained in aggregate form; individually identifiable session data is not retained beyond the active session unless linked to a booking or account.
When information is no longer needed, it is disposed of securely in a manner that prevents unauthorized recovery.
Our website uses cookies and similar technologies including essential cookies (required for site functionality), analytics cookies (to understand visitor behavior), and marketing cookies (to deliver relevant advertising through Google and Meta platforms). By continuing to use our website, you consent to our use of cookies in accordance with this Policy.
You may control cookie settings through your browser preferences. Disabling certain cookies may affect website functionality. Kidiverse does not currently respond to browser-level "Do Not Track" signals, but we will update this Policy if our practices change.
We take reasonable and appropriate measures to protect collected information, including use of secure third-party payment processors, encrypted web communications (HTTPS), and access controls on internal systems. No method of data transmission or storage is completely secure, and we cannot guarantee absolute security.
In the event of a data breach affecting your personal information, we will notify you and, where required, the Florida Department of Legal Affairs in accordance with the Florida Information Protection Act ("FIPA"), Section 501.171, Florida Statutes, within thirty (30) days of our determination that a breach has occurred, or within the timeframe required by law. Notification will include the nature of the breach, the category of information affected, and the steps being taken in response.
You may have the following rights with respect to your personal information:
- Access: Request a copy of the personal information we hold about you.
- Correction: Request that we correct inaccurate or incomplete information.
- Deletion: Request deletion of your personal information, subject to our legal obligation to retain certain records (see Section 7). Note: Signed Waiver records may not be deleted during the mandatory 5-year retention period.
- Opt-Out of Marketing: Unsubscribe from promotional communications at any time via email unsubscribe link or by contacting us.
- Opt-Out of Retargeting: Adjust your advertising preferences through the relevant platform or at www.networkadvertising.org/choices.
To exercise any of these rights, contact our Privacy Officer at info@ourkidiverse.com or call (321) 441-4898. We may require identity verification before processing your request. We will respond within thirty (30) days, or sooner where required by law.
Kidiverse is a Florida-based business subject to Florida state law, including FIPA (Section 501.171, Florida Statutes) and applicable consumer protection statutes under Chapter 501, Florida Statutes. Florida residents have the right to receive breach notification within the timeframe required by FIPA and to file a complaint with the Florida Office of the Attorney General if they believe their rights under FIPA have been violated.
Kidiverse does not engage in the sale of personal data as defined under any currently applicable Florida consumer data protection law. We will update this Policy as new statutes take effect.
Kidiverse is a Florida-based business and does not currently meet the revenue or data volume thresholds that would require mandatory compliance with the California Consumer Privacy Act ("CCPA") or the California Privacy Rights Act ("CPRA"). However, we voluntarily apply reasonable privacy practices consistent with those frameworks, including providing access, correction, and deletion rights upon request, and refraining from the sale of personal data. If our business circumstances change such that CCPA/CPRA applies, this Policy will be updated accordingly.
Kidiverse is located near Orlando International Airport and regularly welcomes visitors from outside the United States, including guests from countries with stronger privacy frameworks such as those covered by the European Union's General Data Protection Regulation ("GDPR"). Kidiverse operates and manages all personal data from the United States, and all data collected is subject to United States law. By using our Services, international visitors consent to the collection and processing of their data in the United States in accordance with this Policy. We do not currently maintain a legal establishment or data processing operations in the EU, and are therefore not directly subject to GDPR obligations, though we strive to apply its principles of data minimization, purpose limitation, and transparency in our practices.
We may update this Privacy Policy at any time. Changes will be posted on our website with a revised effective date. Material changes will be communicated to active members and recent Guests by email where practicable. Continued use of our Services following notice of changes constitutes acceptance of the updated Policy.
The designated Privacy Officer for Kidiverse is responsible for overseeing compliance with this Policy and responding to privacy-related inquiries and requests.
